Effective upon acceptance. By clicking “I ACCEPT,” entering an access code, downloading, installing, copying, accessing, or using Toybox Throwdown (the “Game”), you agree to these terms with MakerCade Customs. If you do not agree, do not download or use the Game.
1. LIMITED PERSONAL LICENSE
MakerCade Customs grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the authorized Windows and/or macOS build for your own personal, non-commercial use, testing, demonstration, or evaluation. Every platform build is licensed, not sold. Access to either build does not grant permission to port, redistribute, repackage, or create another platform version.
2. OWNERSHIP & INTELLECTUAL PROPERTY
MakerCade Customs retains all right, title, and interest in and to Toybox Throwdown and all related intellectual property, including without limitation the software, source and object code, characters, names, stories, gameplay systems, graphics, animation, artwork, arenas, logos, user interface, music, sound effects, voice content, documentation, websites, promotional materials, and branding. No ownership rights are transferred to you.
3. NO SALE, RESALE, COMMERCIAL USE, OR MONETIZATION
You may not sell, resell, rent, lease, sublicense, license, charge for access to, bundle with another product or service, monetize, commercially exploit, or otherwise use the Game or any portion of it for commercial purposes without prior written permission from MakerCade Customs.
4. NO DISTRIBUTION OR SHARING
You may not distribute, publish, upload, mirror, host, transmit, share, gift, copy for others, seed, torrent, post to file-sharing services, place in a public or private software repository, or otherwise make the Game or any portion of it available to another person or organization. You may not share a direct download URL, authenticated session, or access code.
5. NO REVERSE ENGINEERING, HACKING, OR CIRCUMVENTION
Except to the limited extent a restriction cannot legally be enforced under applicable law, you may not reverse engineer, decompile, disassemble, decode, decrypt, scrape, inspect for extraction, derive source code from, bypass or defeat technical protections, tamper with access controls, probe for vulnerabilities, circumvent the download gate, or attempt to gain unauthorized access to the Game, website, servers, files, or related systems.
6. NO UNAUTHORIZED MODIFICATION, CLONING, OR DERIVATIVE USE
You may not modify, adapt, translate, port, clone, reproduce, repurpose, or create derivative works based on the Game or its protected content for distribution, publication, commercial use, or representation as your own. You may not extract or reuse characters, sprites, artwork, animations, arenas, sounds, music, code, interface elements, names, logos, or other Game assets in another project without written permission.
7. DO NOT CLAIM THE GAME OR ITS CONTENT AS YOUR OWN
You may not claim authorship, ownership, co-ownership, creation credit, or proprietary rights in Toybox Throwdown or its content. You may not rebrand the Game, remove or obscure copyright, trademark, credit, attribution, or ownership notices, or present the Game as being created, published, licensed, or endorsed by you or another party.
8. ACCESS CODES ARE PERSONAL AND CONTROLLED
An access code is permission to request one authorized download; it is not ownership, a transferable license, or permission to redistribute the Game. Codes may be campaign-specific, recipient-specific, time-limited, disabled, or revoked by MakerCade Customs at any time. Do not post, publish, sell, trade, or share an access code.
9. NO MALICIOUS OR ABUSIVE USE
You may not use the Game or download system to introduce malware, cheats intended to compromise systems, destructive code, automated abuse, denial-of-service activity, credential attacks, unauthorized data collection, or any activity intended to damage, interfere with, or obtain unauthorized control of another system or user.
10. NO ASSET HARVESTING OR MODEL TRAINING
You may not systematically extract, archive, scrape, dataset-build from, or use Toybox Throwdown source code, artwork, characters, audio, animation, text, or other protected content to train, fine-tune, evaluate, or supply a machine-learning or generative model without prior written permission from MakerCade Customs.
11. UPDATES, SUPPORT, AND COMPATIBILITY
MakerCade Customs is not obligated to provide updates, patches, future versions, technical support, online services, continued compatibility, or replacement downloads. Promotional or evaluation builds may change or be withdrawn without notice.
12. “AS IS” SOFTWARE
To the maximum extent permitted by law, the Game is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory. Use of the Game is at your own risk.
13. TERMINATION
Your permission to possess and use the Game ends automatically if you violate these terms. Upon termination, you must stop using the Game and delete all copies in your possession or control. MakerCade Customs may revoke download access or access codes associated with misuse or suspected unauthorized distribution.
14. ENFORCEMENT & RESERVED RIGHTS
Unauthorized copying, distribution, sale, extraction, impersonation of ownership, or misuse of protected Game content may violate copyright, trademark, contract, or other applicable laws. MakerCade Customs reserves all rights and remedies not expressly granted in these terms.
15. ENTIRE DOWNLOAD AGREEMENT
These terms govern the promotional download made available through this access page unless MakerCade Customs provides you with a separate written license. No waiver or permission is valid merely because technical access to a file was possible.
